By accessing or using Natively ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Natively provides AI-powered text correction and improvement services. The Service uses artificial intelligence (OpenAI) to process and suggest corrections to text submitted by users.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Process illegal, harmful, or offensive content
  • Infringe on intellectual property rights of others
  • Attempt to reverse engineer or exploit the Service
  • Interfere with the operation of the Service
  • Share your account with others or resell access

5. Subscriptions and Payments

5.1 Billing

Paid subscriptions are billed in advance on a monthly basis. You authorize us to charge your payment method for all fees incurred.

5.2 Free Trial

We may offer free trials. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

5.4 Price Changes

We reserve the right to change prices with 30 days notice. Continued use after the price change constitutes acceptance of the new price.

5.5 Refunds

EU Consumers: In accordance with the EU Consumer Rights Directive, you have the right to a full refund within 14 days of your initial purchase, no questions asked. To request a refund, contact us at support@natively.pro.

All Users: After the 14-day period (or for non-EU users), refunds are provided at our discretion on a case-by-case basis. We do not provide refunds for:

  • Partial months of service
  • Unused correction credits
  • Accounts terminated for Terms violations

6. Intellectual Property

The Service, including its design, features, and content, is owned by Natively and protected by intellectual property laws. You retain ownership of your original text content.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim:

  • Any warranty that the text corrections will be accurate, complete, or error-free
  • Any warranty that the Service will meet your specific requirements
  • Any warranty that the Service will be uninterrupted or secure
  • Any warranty regarding the quality or reliability of AI-generated corrections

You acknowledge that AI-powered text correction is not perfect and may produce incorrect, inappropriate, or nonsensical results. You are solely responsible for reviewing and verifying all corrections before using them.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATIVELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or content
  • Reputational damage
  • Any damages arising from reliance on text corrections provided by the Service
  • Any damages resulting from errors, mistakes, or inaccuracies in corrections

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. User Responsibility

You expressly acknowledge and agree that:

  • You use the Service at your own risk
  • You are solely responsible for reviewing all corrections before use
  • You should not rely on the Service for critical, legal, medical, or professional documents without independent verification
  • The Service is a tool to assist with text improvement, not a replacement for professional editing, translation, or proofreading services
  • Any decisions made based on corrected text are your sole responsibility

10. Indemnification

You agree to indemnify and hold harmless Natively and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit through the Service

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Natively operates, without regard to conflict of law principles.
